比較民法之研究，除橫向比較我國與其他國家現行民法中具有類似功能的法律制度外，亦可從歷史角度，考察民法概念、制度在各個時代的形成與演變。本學期課程即擬採用歷史的比較方法，以公元二世紀羅馬法學家蓋尤斯 (Gaius) 的《法學階梯》作為基礎文本，探討現行民法中核心制度（權利主體、家庭、契約、所有權、繼承、侵權行為等）的歷史起源及其主要原理，進一步比較羅馬法與現行歐陸各國與我國民法典中的對應制度，以理解各該制度在歷史發展中的演變軌跡。藉由精讀、解析、比較蓋尤斯《法學階梯》與相關文本，亦可培養文本分析與法學論證等法律研究者必備之基本能力。蓋尤斯的《法學階梯》是為初學者撰寫的法學入門教材，其體系深刻影響了歐陸各國乃至於我國民法典，其內容生動而符合直觀，研讀本書將可更深刻掌握現代民法的原理。Compared with the study of civil law, in addition to comparing the legal systems with similar functions in civil law practiced by my country and other countries, we can also examine the formation and evolution of civil law concepts and systems in various eras from a historical perspective. This course adopts a comparative method of history, and uses the "Law of Law" by Roman jurist Gaius in the second century AD as the basic text, to explore the historical origins and main principles of the core systems in the implementation of civil law (rights subject, family, contract, ownership, inheritance, infringement, etc.), and further compares the corresponding systems in the Civil Code of Roman law with the current European and Chinese countries to understand the evolution of each system in the historical development. By carefully reading, analyzing, comparing Yus's "Lapse of Law" and related texts, you can also cultivate the basic abilities that legal researchers must be prepared for text analysis and legal certificates.
