比較民法之研究，除橫向比較我國與其他國家現行民法中具有類似功能的法律制度外，亦可從歷史角度，考察民法概念、制度在各個時代的形成與演變。本學期課程即擬採用歷史的比較方法，以公元二世紀羅馬法學家蓋尤斯 (Gaius) 的《法學階梯》作為基礎文本，探討現行民法中核心制度（權利主體、家庭、契約、所有權、繼承、侵權行為等）的歷史起源及其主要原理，進一步比較羅馬法與現行歐陸各國與我國民法典中的對應制度，以理解各該制度在歷史發展中的演變軌跡。藉由精讀、解析、比較蓋尤斯《法學階梯》與相關文本，亦可培養文本分析與法學論證等法律研究者必備之基本能力。蓋尤斯的《法學階梯》是為初學者撰寫的法學入門教材，其體系深刻影響了歐陸各國乃至於我國民法典，其內容生動而符合直觀，研讀本書將可更深刻掌握現代民法的原理。

The study of comparative civil law, in addition to horizontally comparing legal systems with similar functions in the current civil laws of our country and other countries, can also examine the formation and evolution of civil law concepts and systems in various eras from a historical perspective. This semester's course plans to adopt a historical comparative method, using "Ladder of Law" by Gaius, a Roman jurist in the second century AD, as the basic text to explore the historical origins and main principles of core systems in current civil law (right subjects, family, contracts, ownership, inheritance, torts, etc.), and further compare Roman law with the corresponding systems in the current civil codes of European countries and my country to understand the evolution of each system in its historical development. Through intensive reading, analysis, and comparison of Gaius' "Ladder of Law" and related texts, you can also cultivate the basic abilities necessary for legal researchers such as text analysis and legal argumentation. Gaius' "The Ladder of Law" is an introductory law textbook written for beginners. Its system has profoundly influenced the civil codes of European countries and even our country. Its content is vivid and intuitive. Reading this book will help you gain a deeper grasp of the principles of modern civil law.
