(一)課程目標:本課程最核心之目的在於引導履修者形塑專題研究之問題意識,並指導其能依據所形塑之問題意識收集、分析國內外文獻並展開論理性的議論與研究。
(二)課程內涵:本課程分以下五大領域:Ⅰ偵查行為論:1.行政調查與刑事偵分;2.強制處分與任意處分。Ⅱ偵查主體論—檢察官論:1. 檢察一體與警察;2. 檢察官的舉證責任。Ⅲ偵查效果論:1.公訴權濫用論;2.偵查與證據排除法則。Ⅳ偵查構造論:1.彈劾構造與糾問構造;2.偵查中之辯護權論。Ⅴ偵查跨域論—國際司法互助。
以上五大領域分十二週講授,採案例研析問答式講授法,於此期間,由任課教師引導履修者形塑問題意識並指導其進行研究。第十三週開始,由履修者發表其所形成之問題意識及所進行研究之成果,並接受其他履修者之質詢,再由任課教師總結講評。(I) Course objectives: The core purpose of this course is to guide the problem consciousness of the shaping topic research by practitioners, and to guide them to collect, analyze domestic and foreign languages based on the problem consciousness they are shaping, and to carry out rational discussions and research.
(II) Connotation of the course: This course is divided into the following five major areas: Ⅰ Investigation behavior discussion: 1. Administrative investigation and criminal offense points; 2. Strong regulations and arbitrary points. Ⅱ Investigation Subject Discussion—A Prosecutor Discussion: 1. Check the body and the police; 2. The prosecutor's proof responsibility. Ⅲ Discussion on the effectiveness of detection: 1. Discussion on the use of public rights; 2. Discussion on the exclusion method of detection and verification. Ⅳ Investigation Structure: 1. Imperialization Structure and Investigation Structure; 2. Protection of Rights in Investigation. Ⅴ Investigation of cross-domain discussions—International judicial mutual assistance.
The above five major areas are taught in twelve weeks, and are taught in a case analysis and question-based manner. During this period, the teacher will guide the practitioners to shape the problem consciousness and guide them to conduct research. Starting from the 13th week, the practitioners will publish their problems and research results, and will accept the quality of other practitioners, and then give a summary of the lecturer.
