教育目標 Course Target

本人近年多次舉辦法律與文學的研討會,並於2007年曾參與教育部補助法學教育改革計畫-法律與文學,皆獲得極大的迴響,本於這門課程一貫精神,就是要透過感性的文學,使過度理性的法律人從中培養人文素養:文學作品的影響,法律人能在文學作品的無限憧憬中,尋找到靈感及努力的方向,且試著使法律論著得到感動人心的力量;更重要的是,從文學領域中得到敏銳與悲憫,並進一步豐富生命,以免得法律人淪為法匠,正如同諾貝爾文學獎得主高行健所言「文學讓人保持人的意識」,這也是本課程最重要的核心之一。
我國的法學教育,最受人詬病的就是,只訓練出一群操作法條的法匠,而不是法律人,此乃因為我國當前的法學教育,忽略人文精神。刑法議題涉及人的生命、身體、自由、財產,若欠缺人文關懷,在處理刑法問題時,將會陷入僅有思維邏輯,而無人性溫暖的冷酷境地,所以,本課程將以法律與文學為中心開展,讓文學的感性,在理性的法律人內心開啟一扇心靈之窗。「法律與文學」的研究,近年來受到西方眾多學者的關注,然而台灣仍屬待開發的領域,認為兩者是互不相干的兩個平行領域。惟法律與文學彼此間並非完全毫不相干,兩者間仍具相當密切的關聯。在相關的研究中,我們可以分為「文學中的法律」、「法律中的文學」兩個領域,「文學中的法律」注重小說及戲劇中對於法律秩序的描寫研究;「法律中的文學」則是運用文學批評與文學理論來解釋法律各項基本原理原則。
據此,透過兩者的結合可以讓法律的解釋不再是枯燥,更富有人文關懷。近來,司法實務最令人詬病的不外乎是其見解與人民普片的觀感差距甚大,更有所謂「恐龍法官」、「恐龍判決」的批評聲浪。觀察我國的法治教育,多注重在法律條文的解釋與邏輯的訓練,鮮少注重人文關懷的層次,透過文學的媒介,不但使法律的學習更加生動,更能因文學的人文特性使學習者除了法律的專業知識外,了解同理心的重要。如此一來,法律的學習不再是巨塔裡的遊戲,而能與社會大眾的觀點趨於一致。

I have held many seminars on law and literature in recent years, and in 2007 I participated in the Ministry of Education's subsidy legal education reform project - Law and Literature, which received great response. Based on the consistent spirit of this course, it is to use perceptual literature to enable over-rational legal practitioners to cultivate humanistic qualities: the influence of literary works, legal practitioners can learn from the unlimited influence of literary works. In the dream, we find the direction of inspiration and efforts, and try to make legal treatises have the power to move people's hearts; more importantly, we gain sensitivity and compassion from the field of literature, and further enrich our lives, so as to prevent lawyers from becoming legal craftsmen. As the Nobel Prize winner Gao Xingjian said, "Literature allows people to maintain human consciousness." This is also one of the most important cores of this course.
The most criticized thing about our country's legal education is that it only trains a group of legal practitioners who operate legal regulations, rather than legal professionals. This is because our country's current legal education ignores the humanistic spirit. Criminal law issues involve human life, body, freedom, and property. If there is a lack of humanistic care, when dealing with criminal law issues, you will fall into a cold situation with only thinking logic and no human warmth. Therefore, this course will be developed with law and literature as the center, so that the sensibility of literature can open a window of the soul in the hearts of rational legal professionals. The study of "Law and Literature" has attracted the attention of many Western scholars in recent years. However, it is still an unexplored field in Taiwan, and the two are considered to be two parallel fields that are unrelated to each other. However, law and literature are not completely unrelated to each other. They are still closely related. In related research, we can divide it into two fields: "Law in Literature" and "Literature in Law." "Law in Literature" focuses on the study of the description of legal order in novels and dramas; "Literature in Law" uses literary criticism and literary theory to explain the basic principles of law.
Accordingly, the combination of the two can make legal interpretation no longer boring and more humane. Recently, the most criticized thing about judicial practice is that there is a huge gap between its opinions and the popular perception of the people. There are also criticisms of the so-called "dinosaur judges" and "dinosaur judgments." Observing the legal education in our country, most of the emphasis is on the interpretation of legal provisions and logical training, and little attention is paid to the level of humanistic care. Through the medium of literature, it not only makes the study of law more vivid, but also enables learners to understand the importance of empathy in addition to professional knowledge of law due to the humanistic characteristics of literature. In this way, the study of law is no longer a game in a giant tower, but can become consistent with the views of the public.
