本堂課將系統性介紹醫療糾紛的相關議題，並輔以實證法學的相關研究結果作為佐證。課程內容包括醫療契約與醫療行為、醫療過失的民刑事責任、醫療過失的判斷困境、告知義務的迅速擴張、醫療行為的代理決定、組織醫療的法律責任、醫療糾紛鑑定制度面以及實質面的問題、實證醫學與醫療糾紛之間的關係、以及臨床準則等相關議題。上述議題將同時以本研究團隊近十年來，相關的全國性醫療糾紛實證研究結果加以印證，包括醫療糾紛的醫師及病患特質、民事賠償以及刑事訴訟、醫療糾紛鑑定等法學實證研究結果。學生在本課程中，將學習關於醫療過失與醫療糾紛鑑定等重要議題，同時也將學習實證法學研究結果的掌握能力，對於將來從事相關實務工作或者研究的學生而言，是一堂不容錯過的課程。

This class will systematically introduce issues related to medical disputes, supplemented by relevant research results from empirical law as evidence. The course content includes medical contracts and medical behavior, civil and criminal liability for medical negligence, the dilemma of judgment of medical negligence, the rapid expansion of the obligation to inform, agency decisions for medical behavior, legal responsibility for organizing medical care, institutional and substantive issues in medical dispute identification, the relationship between empirical medicine and medical disputes, and clinical guidelines and other related topics. The above topics will be confirmed by the relevant national empirical research results on medical disputes carried out by this research team in the past ten years, including the results of legal empirical research on the characteristics of doctors and patients in medical disputes, civil compensation, criminal litigation, and medical dispute identification. In this course, students will learn about important issues such as medical negligence and medical dispute identification, and will also learn the ability to grasp the results of empirical legal research. It is a course not to be missed for students who will engage in related practical work or research in the future.
