反對徵收大埔農地的抗議行動、318太陽花運動、歷史課綱微調爭議等,近年發生的前述事件,使得「公民不服從」(Civil Disobedience)議題浮上檯面,一度成為媒體與學界的熱議對象。然而,究竟何謂「公民不服從」?它的精神與構成要件為何?如何區辨於其他抗議形式?能否用來指稱台灣現行的某些抗議活動?
  
「公民不服從」是西方政治與社會思想傳統的專門術語,梭羅(Henry David Thoreau)、馬丁路德金(Jr. Martin Luther King)、羅爾斯(John Rawls)、鄂蘭(Hannah Arendt)、德沃金(Ronald Dworkin)等人皆曾撰文分析與探究之,所言各有擅場與側重,也具體對應於特定脈絡。

無論是否認同這種抗議形式,在知識上,我們能做的是廓清其樣貌,掌握其概念意涵和思想理路。因此,本學期課程旨在概述和梳理西方政治及社會思想傳統中「公民不服從」的概念形構與思辨爭議,並檢視學理倡議者的相應社會脈絡、歷史情境與知識系譜。進而,再以具體案例為對象,往返於理論思辦與經驗現象之間,進行分析與探究。

Rawls對於「公民不服從」的界定與論證,是本課程的主要參照文本(第2-4週),但不是遵奉其定義為正解,而是因為他的定義相對明確,並具體提出構成要件與證立方式,再者,後續的學術討論亦常著眼於其定義來延伸或質疑,故將其視為對話與思辨的主要參照對象。而後,以Rawls為基礎,分別向前追溯和向後開展,依序檢視不同學者提出的相關理論學說,並將「公民不服從」定義中的構成要件和道德證立予以議題化(動機與目的、公開性、非暴力、違法行為、接受違法後果等),藉以豐富與深化「公民不服從」的思辨潛能。

Protests against the expropriation of farmland in Tai Po, the March 18 Sunflower Movement, and the history curriculum fine-tuning controversy. The above-mentioned events in recent years have brought the issue of "Civil Disobedience" to the forefront and once became a hot topic in the media and academic circles. However, what exactly is "civil disobedience"? What are its spirit and constituent elements? How to distinguish it from other forms of protest? Can it be used to refer to some of the current protests in Taiwan?
  
"Civil disobedience" is a specialized term in the tradition of Western political and social thought. Henry David Thoreau, Jr. Martin Luther King, John Rawls, Hannah Arendt, Ronald Dworkin and others have all written articles to analyze and explore it. Each has its own expertise and focus, and it also corresponds to a specific context.

Regardless of whether we agree with this form of protest, in terms of knowledge, what we can do is to clarify its appearance and grasp its conceptual meaning and ideological rationale. Therefore, this semester's course aims to outline and sort out the conceptual formation and speculative controversies of "civil disobedience" in the Western political and social thought tradition, and examine the corresponding social context, historical situation and intellectual genealogy of the proponents of the theory. Then, we use specific cases as objects to conduct analysis and exploration between theoretical thinking and empirical phenomena.

Rawls's definition and demonstration of "civil disobedience" is the main reference text of this course (weeks 2-4). However, we do not follow his definition as the correct answer, but because his definition is relatively clear and specifically proposes constituent elements and justification methods. Furthermore, subsequent academic discussions often focus on extending or questioning its definition, so it is regarded as the main reference object for dialogue and speculation. Then, based on Rawls, we trace forward and backward respectively, examine the relevant theories put forward by different scholars in order, and issue the constituent elements and moral justification in the definition of "civil disobedience" (motivations and purposes, openness, non-violence, illegal behavior, acceptance of illegal consequences, etc.), so as to enrich and deepen the speculative potential of "civil disobedience".
