民主國家透過憲法組成國家，透過法律組成政府，經由選舉制度使被統治
的國民有定期表達出其接受統治的意思。而各項政府事務的推動，必須獲得民
意的支持，統治才有合理化的基礎，由於人民因居住不同地方，自然有不同的
施政需求，具有全國一致性質之事物，由中央處理自然合宜；而具有因地制宜
之事物，由中央統一處理，則顯非正辦，地方人處理地方事，地方政府因而出
現。
現代立憲主義課國家機器以義務者，必須符合形式合法性與實質正當性兩
項原則，形式合法性討論依照權力分立原則完成合法性問題；實質正當性談的
是內容的合理妥適問題，此兩者必須兼具，才能符合現代立憲主義隊國家的要
求。
近代政治學是研究政府在做什麼？重點是政府體制與政府作為，而當代地
方政府研究重點，也從地方政府體制與作為，延伸到權力（power）與權力關
係。地方政府與自治的探討，可視為政府體制運作模式的研究領域之ㄧ，隨著
民主政治的推展，地方政府與自治的研究，也越來越重要。

(一)認識地方政府與自治意義、本質及我國地方制度回顧。
(二)瞭解現行我國地方政府與自治體系與基本法治。
(三)瞭解地方政府自治事項與法規。
(四)比較歐美地方政府與自治設計與功能評估。
(五)輔導學生參加地方特考及高普考試，增加就業服公職基會。
