政府為使行政行為遵循公開、公正與民主之程序，以保障人民權益，提高行政效能，增進人民對行政之信賴，特研擬行政程序法草案，經立法院三讀通過後，總統於1999年2月3日公布，並於2001年1月1日施行。行政程序法本質上兼具有程序法與實體法之性質，規範行政機關行使職權處理業務時，所應遵循的流程、手續與步驟等事項，並且對於行政行政行為加以規範，包括行政機關作成之行政處分、締結的行政契約、訂定的法規命令與行政規則、確定的行政計畫、實施的行政指導及處理陳情請願等行為。本課程目的在讓學生理解行政程序法在行政法制的重要性：一方面它規範行政權的運作，藉以保障民權維護法治，另一方面同時要求行政權的行使合法化與效率化，並使得行政權的運作能夠協調行政機關與人民的關係，以符合民主社會對人性尊嚴的重視。本課程設計上，除介紹行政程序法有關規定外，並針對行政機關實施行政程序法的有關問題進行研討。In order to make administrative actions follow openness, fairness and democracy, to protect people's rights, improve administrative efficiency, and increase people's trust in administration, the government specially studied the draft Administrative Procedure Law.
