本課程將藉由專利審查基準、實際案例以及實務經驗分享，期使同學能對專利申請及救濟程序乃至侵權分析與迴避設計有進一步的理解。其次，本課程亦針對商標申請流程、策略及佈局、商標管理及維護等重點進行綱要說明以及實務經驗分享，期能建立同學取得及維護商標權之觀念，並透過商標爭議新聞事件及司法案例，使同學由實際發生案例中，對商標爭議發生事實、爭點、救濟途徑等有充分瞭解。再者，本課程將從事實整理、法律分析、狀紙撰擬以及訴訟攻防等角度，探討智慧財產案件在法院實務上之處理模式。
This course will provide students with a further understanding of patent application, economic remediation procedures and even infringement analysis and avoidance design through patent review criteria, actual cases and practical experience sharing. Secondly, this course also explains the key points such as trademark application process, strategy and layout, trademark management and maintenance, and shares practical experience, in order to establish the concept of students obtaining and maintaining trademark rights, and through trademark dispute news events and judicial cases. In actual cases, students have a full understanding of the actual situation, disputes, economic rescue paths, etc. in trademark disputes. Furthermore, this course will explore the handling mode of smart property cases in court practice from the perspectives of factual organization, legal analysis, paper writing, and lawsuit offense and defense.
