憲法第十六條規定:「人民有請願、訴願、訴訟之權」,在法治國基本思想之要求下,「有權利必有救濟」之理念深植人心。行政救濟係指人民因行政機關之違法或不當行為,致其權益受損害,而向國家請求申訴之制度。
