1.確保勞工的基本權益:勞工保險是一個勞工初入職場所必要的保障。但是,長久以來,勞雇雙方往往忽略此一重要的社會保險法益,導致在勞保事故發生時,勞工無法或難以獲得應有的勞保給付。其結果,勞工必須轉而經由冗長的訴訟程序(勞保條例第72條規定),以取得訴訟正義,惟其是否即能獲得賠償,似乎是有疑義的。
2.訓練學生搜集及分析勞保的能力:勞工保險是社會保險的一環,但其顯然佔有相當重要的地位。在配合勞工法給予進入職場勞工的權益保障之際,法定的勞工保險提供一個穩定的國家給付。其種類繁多,可以給事故勞工各種保障,本課程希望能有系統地簡單介紹勞工保險條例的內容,以讓學生初步了解進入職場的勞保權益,並且訓練學生搜集勞工保險相關資料的能力。
3.訓練國家考試的能力:我國國家考試的種類眾多,法律系學生一向以考試為重,開設此一課程可以與勞工法課程相互補,有助於學生理解勞工法問題的全貌,幫助學生考試通過。所以,本課程將配合以案例解析的方式進行。
4.勞工保險的給付、爭議與救濟,形成一個嚴厲的網路,對於被保險人權益的實現息息相關,因此,本課程的設計也及於勞工保險的爭議與救濟。1. Ensure the basic rights and interests of workers: Labor insurance is a necessary protection for workers who first enter the workplace. However, for a long time, both parties have often ignored this important legal benefit of social insurance, resulting in workers being unable or difficult to obtain due labor insurance benefits when a labor insurance accident occurs. As a result, workers must turn to lengthy litigation procedures (as stipulated in Article 72 of the Labor Insurance Ordinance) to obtain judicial justice, but it seems doubtful whether they can receive compensation immediately.
2. Train students’ ability to collect and analyze labor insurance: Labor insurance is a part of social insurance, but it obviously occupies a very important position. In conjunction with the labor law to protect the rights and interests of workers entering the workplace, statutory labor insurance provides a stable state benefit. There are many types of insurance, which can provide various protections for workers in accidents. This course hopes to systematically and briefly introduce the contents of labor insurance regulations, so that students can have a preliminary understanding of labor insurance rights when entering the workplace, and train students' ability to collect labor insurance related information.
3. Training ability for national examinations: There are many types of national examinations in our country, and law students have always focused on examinations. Offering this course can complement the labor law course, help students understand the full picture of labor law issues, and help students pass the examination. . Therefore, this course will be conducted through case analysis.
4. The benefits, disputes and remedies of labor insurance form a strict network, which is closely related to the realization of the rights and interests of the insured. Therefore, the design of this course also covers the disputes and remedies of labor insurance.
