刑法總則乃規定犯罪成立之一般要件及法律效果之法律規範，其核心之內容為刑法之一般適用原則、犯罪論、法律效果論及競合論。刑法總則為刑罰法規（含特別刑法、實質刑法及附屬刑法）之共同適用的準則，亦為研習刑事法之基礎。其中，犯罪論涉及犯罪判斷之客體、犯罪判斷之基準及程序；法律效果論刑罰及保安處分之終極目的、種類、裁量基準及刑事政策之理念。在理論方面固值作深入之比較研究，而在實際運用上，也須注意其妥適性，於學習過程中，也應在抽象與具體之間，來回觀照。

The General Principles of Criminal Law are legal norms that stipulate the general requirements and legal effects for the establishment of a crime. Its core content is the general application principles of criminal law, the theory of crime, the theory of legal effects and the theory of concurrence. The general principles of criminal law are the commonly applicable principles of criminal penalties (including special criminal law, substantive criminal law and subsidiary criminal law) and are also the basis for the study of criminal law. Among them, the crime theory involves the object of criminal judgment, the basis and procedure of criminal judgment; the theory of legal effects, the ultimate purpose, type, discretionary basis of punishment and security measures, and the concept of criminal policy. In terms of theory, it is worth conducting in-depth comparative research, but in terms of practical application, attention must also be paid to its appropriateness. In the learning process, one should also look back and forth between abstraction and concreteness.
