行政法各論業務領域與問題包羅廣泛,但是行政法總論之學習,若未能結合此兩者進行,勢必流於空泛難解。尤其是對於尚未有行政執法實務經驗之學習者,透過實際之個案及執法(行政、司法)實務,檢視相關之行政法學理論及通則性之規定,在學習效果上,益見其重要。也希冀藉由個案之雙向討論,加大討論之深度與廣度,貫徹學問之研究終究回歸問題之解決的要求。當然為提高學習之興趣與問題意識,研討之題目也納入最新之實務發展。The various business areas and problems in administrative law are broad, but if the learning of the general discussion of administrative law fails to combine these two, it will inevitably be empty and difficult to solve. Especially for those who have not yet learned the practice of administrative law, it is more important to examine relevant administrative law theories and general regulations through actual cases and legal (administrative, judicial) practices. We also hope to use the dual discussion of a case to increase the depth and diversity of the discussion, and learn the requirements of finally solving the problem by asking questions. Of course, in order to improve learning interest and problem awareness, the research topics also include the latest practical developments.

有鑑於此,本學期之專題研究,將把本校座落所在之台中市與台中縣,將於明年底合併改制直轄市之法制過渡問題、較具爭議新發生之稅法案例、以及環境法之議題納入。其中環境法在法律體系中,不論從行政法或民法之角度,嚴格說來,應歸屬各論之領域。但因其問題涵蓋廣泛,已快速發展自成一體為環境法之單獨法領域。本課程係從行政法之公法角度探討我國目前(一)、環境法制上相關法規的主要內容、(二)、重要之環保行政法律問題、(三)、常見之實務案例類型、(四)我國幾個重大環境案件之介紹、(五)、德、美等國相關規定之介紹比較。希望藉由此一課程,讓參與者對此一領域之主要法律及問題之處理,無論學理或實務,均能達到一定程度之了解。

In light of this, the topic research of this school will include the legal transition issues of Taichung City and Taichung County where the school is located, the legal system transition issues of the direct market at the end of next year, the cases of new tax law that are more disputed, and the issues of the Environmental Law. Among them, environmental law in the legal system, regardless of the perspective of administrative law or civil law, should be classified as a field of various discussions. However, due to its extensive coverage, it has rapidly developed into a single legal domain of environmental law. This course explores the current content of relevant laws in my country from the perspective of public law in administrative law, (ii), the main contents of relevant laws in the environmental legal system, (iii), important environmental administrative legal issues, (iii), types of common practical cases, (iii) introductions of several major environmental cases in my country, and (v), introductions of relevant regulations in Germany, the United States and other countries. We hope that through this course, participants can understand the main laws and problems in this area, regardless of science or practice.
