全球化的概念，含蓋了經濟學、社會學、法學、哲學、歷史學以及政治學等範疇。跨國犯罪現象也適用全球化這個概念。全球化的概念並不屬於法律構成要件的概念，而是不斷經由經濟、社會、政治、文化、以及法律體系結構交互影響而成。刑法的全球化(Globalisierung des Strafrechts)這個概念較少從經濟學以及國家行為本課程的上課目標，希望藉由跨國犯罪之認識，了解國際的情勢與脈動，具備廣博的世界觀，或能尊重或包容不同文化間的差異。The concept of globalization covers the fields of economics, sociology, law, philosophy, history and political science. The concept of globalization also applies to the phenomenon of transnational crime. The concept of globalization does not belong to the concept of legal elements, but is continuously influenced by the interaction of economic, social, political, cultural, and legal system structures.
