教育目標 Course Target

行政法是憲法的具體化,大法官釋憲的結果(如與勞工保險有關的釋字第568號解釋、與健保有關的釋字第533號解釋、與學生權益有關的釋字第864號解釋等)、法院裁判的進步以及學界的努力,逐步要求我國行政法制改善,以符合憲法人權保障的理念。從二十一世紀初起,許多影響我國行政法制度的法典逐一實施,從新制定的行政程序法以及陸續修訂的行政執行法、行政訴訟法、訴願法、公務人員保障法等,到2005年通過的行政罰法等,若加上大法官的解釋以及新學說,便可以發現行政法在我國所顯現的「活力」。但是,這種活力卻導致學生普遍失去方向,視學習行政法為畏途。本課程設計主要採「體系教學法」,以行政法之概念體系為綱領,有系統的帶引同學進入繁雜的行政法領域中,此外,輔以個案分析與行政法院之判決,讓學生能有效運用行政法學理。

Administrative law is the embodiment of the Constitution. The results of the interpretation of the Constitution by the justices (such as Interpretation No. 568 related to labor insurance, Interpretation No. 533 related to health insurance, Interpretation No. 864 related to student rights, etc.), the progress of court judgments, and the efforts of academic circles gradually require the improvement of my country's administrative legal system to comply with the concept of human rights protection in the Constitution. Since the beginning of the 21st century, many codes affecting my country's administrative law system have been implemented one by one, from the newly enacted Administrative Procedure Law and the successively revised Administrative Enforcement Law, Administrative Litigation Law, Petition Law, Public Servants Protection Law, etc., to the Administrative Penalty Law passed in 2005. If you add the interpretations of the justices and new doctrines, you can find the "vitality" of administrative law in our country. However, this vitality has led to students generally losing their direction and viewing administrative law as a daunting path. The design of this course mainly adopts the "systematic teaching method", using the conceptual system of administrative law as the guideline to systematically lead students into the complex field of administrative law. In addition, it is supplemented by case analysis and administrative court judgments to enable students to effectively apply administrative law theories.
